When you use a credible witness to identify a signer, the notary must administer an oath or affirmation to the credible witness in substantially the following form: “Do you (solemnly swear, or affirm) that you personally know _____ (name of person who signed the document)?” A credible witness is defined as someone who: 1. Swears or affirms that the signer of a document is the person whom they claim to be; and 2. Is personally known to both the signer and the notary public. The credible witness must be present at the time of notarization. It’s important to note that the credible witness must be impartial and should not have a financial interest in, nor be a party to, the underlying transaction. Additionally, the notary should record the details of the credible witness in their journal, including the witness’s full name, signature, and address, as well as noting that the witness is a credible witness. This process ensures that the identity of the signer is properly verified, maintaining the integrity of the notarization process. . .
