In December 2019, my husband of 20 years received a default divorce under seal by a judge who accepted the case, after a violation of a peremptory challenge of Supreme Court Rule, 48.1 which allows a Litigant to peremptory challenge a judge for no cause provided a judge is named. However, they only named a vacant department in clear violation of the SCR 48.1. Then the judge gave a default without personal jurisdiction, the judge signed the default without looking at it and later, when it was brought to her attention that there were no dollar values to any of the assets, she just simply stated it seemed fair and denied my appeal to set aside the default for lack of jurisdiction. Hello, I had to appeal to the supreme court court of appeals, wait over a year and a half for an answer. I won a reverse and remand, and remained under the rule of that same judge who later sanctioned me from bringing forth any evidence and subsequently granted my husband an additional $750,000 of the estate. The matter is deep… people have di3d. It’s still ongoing at the court of appeals. I hope to have an answer next month in February or in March but it still won’t likely address that I need a new judge. I’ve been quiet I’ve never spoke publicly about this till now out of respect, consideration and fear of further retaliation, and maybe to my detriment, but I can no longer leave everything in the hands of the court and I can no longer go without asking for help. I know I’m not alone and I know other people have it worse. But I’m not gonna hide anymore, and I need your help to give me the strength and the courage and the energy to persevere.
